Please read and agree to the following Terms and Conditions when making a purchase through our website.

CONTRACT FORMATION

  1. These terms and conditions (“Terms”) apply to the sale of all goods online between Moor to Sea Arts, 8 Luscombe Close, Ivybridge, Devon PL21 9TT UK (“we/us”) and any visitors (“you”) to the website at www.moortoseaarts.co.uk(“Site”). Please Contact Us for all enquiries pre- and post-sale.

  2. No contract shall exist between you and us for the sale of any goods until we accept your order after payment online.

  3. We have taken all reasonable precautions to ensure the security of your personal data and order details. Accordingly, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to your information, either on our Site or our payment provider’s.

    PRICING

  4. The price you shall pay for the goods is the price displayed on our Site at the time we receive your order.

  5. The price and description of the goods are displayed on our Site. Such information is subject to change without notice.

  6. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or, if you choose, to cancel the order. If you choose to cancel the order we will issue a full refund of any amount charged.

  7. You may choose to pay by credit or debit card. We use third party payment processors who use encryption technology to ensure a secure checkout.

  8. The price of the goods is payable in full at point of sale.

  9. Receipts for payment will be sent by email after payment for any purchases made online from the Site. All goods remain our property until cleared payment is received from you.

    SHIPPING

  10. UK destinations: P&P which will be calculated and added at checkout before you complete the transaction.

  11. Destinations outside UK: Please contact us before purchasing. We will not fulfil orders for destinations outside the UK without prior arrangement. Your payment will be refunded minus an admin fee.

  12. Note that all original artworks are supplied unframed. The size of the artwork stated on the website is the size of the image. The support (paper, board or canvas) may be slightly larger to allow for framing.

  13. Original paintings are shipped flat packed with insurance.

  14. Fine Art Prints are shipped rolled in postage tubes with insurance. It is advisable to unroll the print as soon as possible after receiving it/them, and to store them flat prior to framing.

  15. We do not ship books outside the UK. We will not fulfil orders of books to addresses outside the UK. Your payment will be refunded minus an admin fee.

  16. Please be aware that your purchase may be subject to import duty in the destination shipping country. Payment of such fees is your responsibility.

    DELIVERY

  17. Please allow 30 days for delivery of physical items. We aim to dispatch an order as soon as possible after the order has been accepted, but there may be delays. If we are unable to deliver within 30 days we will inform you as soon as possible. You will then have the option to cancel the order and receive a full refund. We will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

  18. We shall not be liable to you for any failure to deliver the goods that have been ordered by you or any delay, damage or defect to the goods collected which is caused by any event or circumstance beyond our reasonable control.


    DESCRIPTION OF GOODS

  19. We make every effort to ensure that all images are displayed as accurately as possible. However, we are unable to guarantee complete accuracy because the appearance of an image on screen is dependent up on the screen on which it is viewed. Colour, brightness levels, contrast and even resolution may vary from screen to screen. Please keep this in mind when viewing artwork on our Site. In making a purchase you agree to accept these differences.

  20. We may correct any typographical or other errors or omissions in any online entry, sales literature, quotation or other online document relating to the sale of the goods without any liability to you.

    AVAILIBILITY

  21. All goods are subject to availability.

  22. If we are unable, for any reason, to deliver the goods ordered by you, we will inform you of this as soon as possible and give you the option of providing you with substitute goods of equivalent quality and price, or a full refund.

    RIGHT TO CANCEL

  23. In accordance with UK law you may cancel an order for goods for any reason within fourteen working days, beginning with the day on which you received the goods.

  24. If you wish to cancel an order within this timeframe, you should Contact Us. You will be responsible for the cost of returning the goods.

  25. You must return the goods within fourteen days of cancellation and at your own expense. All returned items must be undamaged, in a condition suitable for immediate resale. A refund will be issued once we have received the goods and checked their condition. Items returned undamaged will receive a full refund. If the items returned show any signs of damage the amount of the refund we offer will be at our discretion.

    GOVERNING LAW

  26. English law applies to these terms and conditions and any sale of goods to which they apply and you agree to submit to the exclusive jurisdiction of the English courts in all matters arising from these Terms.
